A Lancaster County District Court has dismissed a lawsuit which sought to block the implementation two Nebraska medical cannabis initiatives.

Judge Susan Strong ruled Thursday that the Plaintiff, John Kheun, does not have standing.

In the lawsuit, Kheun, a former state Senator and affiliate with the “anti-marijuana” organization Smart Approaches to Marijuana (SAM), alleged that the measures—initiatives 437 and 438—were unconstitutional under both state and federal law.

“This is yet another failed attempt to strip away the will of the people, and should send a clear message to the opposition that they have lost,” said Crista Eggers, Executive Director of the ballot organizing group Nebraskans for Medical Marijuana (NMM). “Many years of hard work have gone into this effort-from volunteers, patients, and families across the state. Today marks the reality that we will finally see the day that we, and all Nebraskans have fought for.”

The door is open for the suit to be refiled.
